We are experts in the practice of lemon law, as well as the practices of the auto industry. We recognize how difficult it can be to deal with a valuable technological feature that was not ready for mass market, or a low-quality product that was introduced to help save a few dollars per unit.
These practices — and the emerging trend of auto industry scandals — led us to found Goldsmith West. Today, we utilize our knowledge, experience, and a personal network formed during years of practice within the industry to the advantage of consumers, who must face the immense resources of auto manufacturers when a product dispute arises.
We are passionate consumer advocates who stay current on the latest legal issues and industry developments that affect our clients. Some of our memberships and subscriptions include the following legal organizations:
We are committed to the advocacy of people like you, who require legal relief under the Song-Beverly Consumer Warranty Act, the Magnuson-Moss Warranty Act, Uniform Commercial Code Breach of Warranty causes of action, the Consumer Legal Remedies Act, violations of the Business & Professions Code, any aspect of dealership fraud or products liability, or any other claim related to lemon law.
Our goal at Goldsmith West is to explain the law and the merits of your lemon law claim, so you can make the best decisions based on your wants and needs, whether it involves pursuing resolution on your own, settlement negotiation through our team, or litigation.
David Allan Goldsmith began his career after graduating from University of California San Diego and earning a law degree from the University of San Diego Law School. He spent five years at a Los Angeles-based boutique law firm that specializes in the defense of product manufacturers, followed by seven years of working in-house at Bentley Motors, Inc.
At Bentley, where he was the only attorney employed in the Americas region (United States, Canada, Mexico, South America and the Caribbean), David headed consumer affairs, as well as serving in other roles.
Because the Song Beverly Consumer Warranty Act, the Magnuson-Moss Warranty Act, and other lemon law-related statutes apply to all consumer products, we also represent consumers for a diverse array of other products, including: boats, appliances, TVs, computers, and even expensive musical instruments, such as pianos.
Automobile functions are increasingly governed by computerized control modules and software, and we take particular interest in the defects arising out of digital technology. In recent years, these have included Transmission Technologies such as the Dual-Clutch Automated Transmission, the Continuously Variable Transmission (CVT) system employed heavily by Nissan, and the ZF transmission systems used in Jeep, Chrysler, Dodge and Fiat products; as well as a variety of defects related to “infotainment” systems and driver assistance features, such as those present in Tesla products.
Given David Goldsmith’s experience in the luxury automotive sector, we also specialize in problems for low-volume, partially hand-built products from brands such as Maserati, Rolls Royce, Aston Martin, McLaren, Land Rover, Lamborghini, Ferrari, Bugatti, Koenigsegg, Porsche, McLaren, Jaguar, and other high-end automobiles.
In addition to our lemon law vehicles and products practice, we accept cases arising under strict product liability, labor and employment law, personal injury, and the Fair Debt Collection Practices Act.
